Federal Judge Denies DOJ's Request to Review Evidence in Roman Storm Case

A federal judge declined to order the Department of Justice to review materials that could assist Tornado Cash developer Roman Storm's defense before his upcoming trial.

During the hearing, Judge Katherine Polk Failla informed the DOJ that there should be no issues related to disclosures. The court concluded that no requests would be entertained to review any DOJ records that might assist Storm’s case. Failla specifically asserted that she did not view any undisclosed materials as exculpatory, thus affecting the proceedings forward.

She commented, “I’m not going to require a further review based on the representations made that there’s no additional material of this type…”

Furthermore, both the prosecution and defense presented arguments concerning conversations with the Financial Crimes Enforcement Network (FinCEN) about regulatory expectations for mixers but concluded that licensing was not applicable in this case. If the judge had found evidence of withheld information, it could have influenced the trial’s outcome. The judge has urged prosecutors to avoid altering charges in the time leading to the trial, signifying fairness to the defense.
