Upcoming US Crypto Legislation: Key Bills on the Horizon

Three major crypto bills could be on the verge of passing in the House of Representatives soon: the GENIUS Act, the Clarity Act, and the Anti-CBDC Act.

The GENIUS Act (Guiding and Establishing National Innovation for U.S. Stablecoins of 2025) is intended to establish a regulatory framework for stablecoins. Having already cleared the Senate, it’s likely to be the first crypto-focused legislation to be signed into law.

The Clarity Act, another significant piece of legislation, aims to delineate the regulatory authority between the SEC and CFTC regarding digital assets. This clarity has been long awaited by the crypto industry, according to Katherine Dowling, General Counsel at Bitwise.

The Anti-CBDC Surveillance State Act would ban the federal government from creating a central bank digital currency (CBDC). Tom Emmer, the bill’s sponsor, has emphasized that a CBDC, if not designed for privacy and decentralization, could turn into an Orwellian surveillance tool.

All three bills are projected to gain bipartisan approval, marking a significant step forward for the crypto industry. Although there are imperfections in these proposals, Dowling believes they will help clarify regulatory uncertainty, enabling crypto firms to function more readily in the US.

As other nations make progress, Dowling has noted that the US must maintain this momentum. With the recent shifts in Washington’s attitude towards crypto, momentum is essential for future advancements in legislation.
